"Complying with the rules of natural justice (this has a specific legal meaning covering the rule against bias and the right to a fair hearing);" The above is included in the current Racing Act even though there is no actual reason to spell it out as such, given that the essence of this clause is imputed into all legislation. By including it in writing, the Act recognises the importance of this principle in an Act governing an industry such as the Racing Industry and its gambling component. The problems in our racing industry stem directly from the abject failure of those legally responsible for the maintenance of integrity within the racing industry to honour their legal obligations in this regard. Their ability to act in a blatantly illegal manner is sustained by the actions of the Act's architect, Sir Geoffrey Palmer (who openly refers to the Act as "his Act") in allowing "his Act" to be deliberately misinterpreted. In a face-to-face meeting with Sir Geoffrey, he told me that the New Zealand Racing Board did not have to act in regard to allegations of corruption within the Racing Industry. When I pointed out this very clause in "his Act", he would not discuss the implications of this clause but continued to state that the NZRIB did not have to act in relation to allegations of corruption. I have a letter from a NZRIB-employed lawyer telling me that the Board had a legal opinion that they did not have to act in regard to the allegations of corruption that I was bringing to their intention. This lawyer resigned his position with the NZRIB shortly after I received his letter and I often wonder whether having to send me that letter played any part in his doing so. The new incarnation that goes under the acronym RITA seems to simply constitute the continuation of the corruption under a new name. I wish to point out that I post under my real name and that all the details that lead to my full identification are publicly available on this website. This means that Win, Place, Quinella, First4 and Quaddie bet types are currently uncommingled and Australian races will be closing at the advertised start times.
