Glen Boss may be permitted to ride Constantinople in the Melbourne Cup purely on the timing of his careless riding appeal hearing.

Boss lodged an appeal against the severity of his penalty after being found guilty by Racing NSW stewards for his ride on Attention Run in last Saturday's Listed Clubs NSW City Tattersalls Club Cup (2400m) at Randwick.

Boss was suspended for six meetings, from Sunday, November 3 to Saturday, November 16.

But Racing NSW announced on Tuesday afternoon that Boss' appeal hearing has been set for Monday at 9:30am.

The significance of the Melbourne Cup eve appeal hearing is that New South Wales rules allow jockeys to fulfil their riding engagements for up to 48 hours after an appeal hearing.

Consequently, Boss may not reduce his suspension sufficiently on appeal yet still be allowed to ride in the Melbourne Cup.

It's unclear at this stage how Racing Victoria stewards will deal with the scenario.

There's a couple accepted that may decide to take the chance. Downdraft also. Angel Of Truth must be on the cusp of pulling out of the cup as well. Done absolutely nothing as a 4yo. Raheen House is lame after the Bendigo Cup (but a bit further down the order).

Wow it seems a high rate of attrition this year for the final 10 days or so.

Good to see Vow and Declare will make it after all (since I have him in the comp) but terrible breeding for the 2 miles.

Raymond Tusk is just a wonderful name for a horse.

Have a blast Mardi, make the bookies' bags lighter and feet heavier.

I speculate that they will want to stick it up the NSW stewards!
